Exemption for the installation of floating floors

Exemption from the requirements of the Building Work Contractors Act 1995 for those who install floating floors

The Building Work Contractors Act 1995 (the Act) requires building work contractors to be licensed and building work supervisors to be registered. This currently includes building work contractors and building work supervisors who install floating floorboards.

However, from 1 April 2010 workers who install, repair, maintain or remove floating floorboards will no longer need to be licensed.

What will the changes mean?
Any work done in accordance with a contract for the installation, repair, maintenance or removal of a floating floor which was entered into on or after this date will not be covered by this Act. In terms of impact on consumers, any issues regarding workmanship will be covered by the Fair Trading Act 1987 or Consumer Transactions Act 1972.

The Building Work Contractors Act 1995 continues to apply to any work done under a contract entered into before 1 April 2010.

How will licence cancellations for those licensed only for the installation of floating floorboards work?
On 1 April 2010 OCBA will cancel the licences of those licensed solely for the installation of floating floors and annual returns will not be required thereafter.

What will change for those licensed to perform the installation of floating floors and other work?
On 1 April 2010 OCBA will alter the licences of those who are licensed to install floating floors and also to perform other building work so that the installation of floating floors no longer appears as a licensed activity. These people will still require a licence for the other activities they perform and therefore will still be required to pay licensing fees and lodge annual returns when they become due.
