Terminating a contract

An owner or a builder can terminate a contract, but only in the most extreme circumstances. Terminating a contract is a very serious step and you should obtain legal advice before taking such action. It should only happen in a case where your building work contractor has not complied with relevant provisions of the Act, and before the contractor has completed the building work under the contract.

You must give your building work contractor written notice of your intention to terminate. You must serve that notice on the building work contractor either personally or by certified mail in an envelope addressed to the contractor.

If a contract has been terminated, the Magistrates Court may, on application by the building owner or the building work contractor, make certain orders.
For example: Terminating a contract is a very serious step and legal advice is strongly recommended.
